The Stitched Clothes and Ihram

Note:  It should be remembered that the meaning of wearing is that the cloth is worn in such a way as has been the practice of wearing anything, otherwise, if a shirt is made to wear like an apron and a pajama is wrapped in such a way without inserting the leg in the sleeves, then it means nothing.   In the same way if a shirt is spread on the shoulders, without inserting the armsin the sleeves, then Kaffarah is not applicable but it becomes Mukruh, an abominable act.  If stitched cloths put on the shoulders, without inserting the arms, then no problem.  (Durr-e-Mukhtar, RaddulMuhtar, Alamgiri)

(1)       If a Muhrim (person wearing ihram) by forgetting his status as a Muhrim or willfully wears any stitched dress, and on remembering if he removes immediately, then Sadaqah becomes obligatory (wajib).  (This is for wearing the stitched dress for a short time).  If on account of oblivion or willfully wears the dress for full day and a full night i.e. from the dawn to dusk, or from dusk to dawn, or from afternoon to midnight or from midnight to afternoon, or more than this, say continuously for  a few days, then Dam would become obligatory. (This is for wearing the stitched dress for a longer time). (FatawaRadhviyaMukharrajah, Volume 10, Page 757)

(2)       Man covering the full head or one fourth (1/4) but a man or a woman covers the mouth and surrounding area or one fourth continuously for four noon or more than that then a Dam is applicable.  If less than a fourth of the face or head (1/4) for less than four noon and if full face or head is covered, then Sadaqah has to be given and less than one fourth of the face and head is covered for less than four noon  then there is no Kaffarah, but it is a sin.  (FatawaRadhviyahMukharrajah, Volume 10, Page 758).

(3)       In cold and flu, don’t clean the nose with cloth or towel.  Keep away the towel or cloth while cleaning the nose.

(4)       While sleeping, except the face full body can be covered by a stitched blanket or more than one coverlet, even if both the feet get covered.

(5)       If the face gets covered in sleep, a Kaffarah is applicable in such cases also.  (Bahar-e-Shariyat, Volume 1, Part 6, Page 1169)

(6)       It is not permitted to cover the head for a person wearing ihram.  If he covers his head with such a material which is not made of cloths and his intention was not to cover the head, for example, if he takes a package of provision over his head, any utensil, wooden board etc. that is permissible, because they are of not made of cloth material.  Moreover such an act does not show the purpose of covering the head.  If someone takes the load of cloths over his head, then it is not permissible, because this would be counted amongst the substance of cloths only.  However, the woman wearing ihram could take this load of cloths over her head, because she has been commanded to cover her head.  (Bidae Al-Sanae fi tarteeb Al-shara’, ChapterMahdhurath Al-Ihram, Volume 5, Page 106, FatawaAlamgiri, Book of Rituals, 8th Part in al-Janayath,  Chapter 2, Volume 1, Page 242, Bahar-e-Shariyat, Volume 1, Part 6, Pages 1083, 1169)

(7)       If stitched cloths are worn before the intention of ihram (Niyyah) pronounced, then after the pronouncing Niyyah immediately the stitched cloths removed and again unstitched ihram coverlets are worn, in such case, Sadaqah has to be given.

(8)       If a Muhrim prior to Niyyah of ihram forgotten to remove the cloth or cap from his head, then after pronouncing the Niyyah they were removed immediately, then a Sadaqah has to be given.

(9)       If the face gets covered by another person’s coverlet in the crowd, a Sadaqah is applicable.  In such case, the person wearing ihram would not become a sinner since he did not cover the head or face willfully.  If deliberately the head or face is covered, then it is a sin and a Kaffarah also becomes applicable.

(10)    If a man covers full or one fourth of his head in ihram, like normally wearing a cap, turban or covering head with a blanket, covering the head to save from sun light, or tying the head with cloth due to head ache, or applying bandage due to any injury etc. a penalty becomes obligatory, if these shortfall have been committed in oblivion, while sleeping or unconsciously  or due to any excuse.  This is a sort of sin for the atonement of which a penalty has been prescribed as has been in the case of prayers, on forgetting to perform any ritual of the prayers; a SajdaSahu becomes obligatory (wajib). The difference between an excuse and deliberation is that if without any excuse or genuine reason if someone covers the head for one full day or for one full night or for a period more than this, then one Qurbani (slaughter) has to be given in Haram at any time as per his wish.  While in the case of genuine excuse, such as fever, flu, injury or any pain, if he covers the head for such time as has been mentioned above, it is given to him that he gives a slaughter in the Haram or anywhere anytime he wishes, or three Saa’ (that is 12 kilo grams) wheat in between 6 poor people in such a way that each one may get half Saa’ (or  two Kilo grams) or six Saa’  (that 24 kilo grams) barley in between 6 poor people in such a way that each one may get half a Saa’ (four kilo grams barley per head) or fast for three days in case the head had been covered for less than a full day or less than a full night, if it was covered only for a small time then in the case of no excuse, SadaqahFitr like specific Sadaqah becomes applicable. That is to say, half a Saa’ (or two kilo grams) wheat or one Saa’ (or four kilo grams of barley).  This too can be given anywhere as he likes.  In case of excuse, he may have to give one Sadaqah or fast for a day anywhere he wishes.  (FatawaRadhviyah, Moliqsan, Volume 10, Page 713)

            There is  a hadith from Bukhari Sharif is that, taking the reference from AbdurRahman Bin AbiLailahRaziallahuanhu, HadratKa’b Bin AjrahRaziallahuanhu narrated that  at the place of Hadabiyah, the Prophet sallallahualaihiwasallam pay his holy visit to me and stayed, then he saw lice falling on my face and said, “it seems that the lice and troubling you?”  I said, “yes.  He sallallahualaihiwasallam said, “you get shaved” then at this time a holy ayah,

وَلَا تَحْلِقُوۡا رُءُوۡسَکُمْ حَتّٰی یَبْلُغَ الْہَدْیُ مَحِلَّہٗ   فَمَنۡ کَانَ مِنۡکُمۡ مَّرِیۡضًا اَوْ بِہٖۤ اَذًی مِّنۡ رَّاۡسِہٖ فَفِدْيَةٌمِّنۡ صِیَامٍ اَوْ صَدَقَةِِاَوْنُسُکٍ"

           

Translation :  Before the Qurbani (slaughter) reaching its place, do not shave head and if someone amongst you is sick or he has some trouble in his head, then Fidya is imperative on him, fasting or Sadaqah or Slaughtering.

Then the Prophet sallallahualaihiwasallam moreover said, “(in its Kaffarah) fase for three days or one day.  The difference is that three Saa’ (12 Kilo) wheat in between 6 poor people may be distributed, or give the available animal in slaughter. (Bukhari Sharif, Chapter : Chapter of saying of Allahuta’la {or Sadaqah} where feeding six poor people, hadith number 1850, Volume 30, Page 10,  Al-Nashir : DarulTauq Al-Najah)

Hence, in the light of Al-Qur’an, hadith and the Islamic  jurisprudence, each poor will get half Saa’ (2 Kilo grams) wheat.  Though the last part of the hadith give the tafsir of this holy verse (ayah kareema)

            “Walaatahliquru’oosakumhaththayablughahadyumahillah, famankaanaminkummareezanaobihiaza man raasihifafidyatum man siyaaminaosadaqahaonusuk.

وَلَا تَحْلِقُوۡا رُءُوۡسَکُمْ حَتّٰی یَبْلُغَ الْہَدْیُ مَحِلَّہٗ   فَمَنۡ کَانَ مِنۡکُمۡ مَّرِیۡضًا اَوْ بِہٖۤ اَذًی مِّنۡ رَّاۡسِہٖ فَفِدْيَةٌمِّنۡ صِیَامٍ اَوْ صَدَقَةِِاَوْنُسُکٍ"

as such and the clarification of the holy Prophet sallallahualaihiwasallam has made it clear that three fasts are obligatory (wajib) and if Sadaqah is given then three Saa’ that is 12 Kilo grams of wheat to be distributed between six poor people, in such a way that each one may get half a Saa’ or two kilo grams of wheat. 

It has been clarified that due to the necessity shaving head, covering the head, covering head for the protection from sun light, tying the head due to head ache, applying bandage for injury etc. the Sadaqah is given in the way as has been mentioned above.

(11)    If without any necessity, all the dresses are worn at a time, then that would amount to only one sin.  Two sins are counted at the time when one was worn with the necessity and the other without any necessity.  (Bahar-e- Shariyat, Volume 1, Part 6, Page 1168).

(12)    If the face is covered by both the hands or someone keeps his hand on the   head then it amounts to nothing.

(13)    A Muharim would not wear the socks, if he wears, then the same Kaffarah   for wearing the stitched cloth applies.

(14)    If the stitched cloths loaded on the shoulders, it is permissible.  No Kaffarah  is applicable for this act. (Bahar-e-Shariyat, Volume 1, Paert 6, Page 1169).
